Yes. Different types of shareholders agreements can be customized, taking into account the special needs and stages of startups.
- Early-stage startups: a simplified shareholders agreement can be drafted including traditional provisions such as confidentiality, non-competition, intellectual property, and operation and management of the corporation. More complex provisions such as general corporate governance or insurance matters would not be covered as they would be unnecessary.
- Growth stage startups: a more substantive shareholders agreement can be drafted including corporate governance guidelines as well as provisions that focus specifically on corporate finance, share capital, buy-sell provisions and takeover bids.
